Winchester Delivers First Lake City AAP Shipment to the U.S. Warfighter

EAST ALTON, Ill. — Winchester announces its first shipment of ammunition to the U.S. government left the Lake City Army Ammunition Plant yesterday.

Semitrailers filled with 50 caliber and 5.56 ammunition are bound for destinations around the globe in support of the U.S. Warfighter.

“This is an important milestone for Winchester, our first shipment to the U.S. government after just assuming management and operational control of Lake City,” said Brett Flaugher, president of Winchester. “Our ability to execute through this transition process and make our first delivery within two weeks is a testament to our dedicated work force.”

The U.S. Army selected Winchester to operate and manage the Lake City Army Ammunition Plant in September 2019. The contract has an initial term of seven years and may be extended by the U.S. Army for up to three additional years. Winchester is now the world’s largest small arms ammunition manufacturer.

CCRKBA from Rasmussen: ‘Americans Who Own Guns Feel Safer’

‘AMERICANS WHO OWN GUNS FEEL SAFER,’ SAYS CCRKBA ABOUT RASMUSSEN REPORT

BELLEVUE, WA – A new Rasmussen poll showing an overwhelming majority of Americans who have added a gun in their home since the Black Lives Matter anti-police protests started six months ago “feel safer” comes as no surprise, the Citizens Committee for the Right to Keep and Bear Arms said today.

“Perhaps the most important revelation in this survey,” said CCRKBA Chairman Alan Gottlieb, “is that 39 percent of Democrats own guns, which means Joe Biden and Kamala Harris are alienating a huge bloc of potential voters with their extremist gun control agenda less than a month before the November election.

“And they’re also not making any friends among the estimated five million-plus new gun owners who purchased a firearm for the first time since these destructive demonstrations began,” he added. “Those Americans bought guns to protect their families and homes while Biden, Harris and other far left Democrats have publicly supported protesters and their demands to defund police departments across the country.”

According to Rasmussen, 54 percent of adults who live in gun-owning households feel safer, and a whopping 90 percent of people who have added a gun in the last four months “feel more safe.”

“Why should this surprise anybody,” Gottlieb wondered. “We’ve been treated to months of images on the nightly news showing cities under siege, businesses being vandalized, looted and even burned. People have been killed, more have been injured including scores of police officers, and all we hear from protesters are demands for cuts to police departments, while radical city councils work overtime to appease the mob.

“Who in their right mind wouldn’t take steps to make their home and family safer,” he questioned. “Yet Biden wants to make it harder for honest citizens to exercise their Second Amendment rights, and Harris is waiting in the wings with her own extremist agenda if Biden—should he win in November—is unable to finish his term.

“The last six months have taught millions of people the importance of having a constitutional right to own a firearm,” Gottlieb observed. “They’ve learned how restrictive and pointless some gun control laws can be. Now they’re being asked by two anti-gun career politicians, and their party, for support so they can enact even more restrictions while they erode public safety and expect the American public to accept this as the ‘new normal.’ No wonder people are buying guns. They’re praying for the best, but preparing for the worst.”

NSSF: Biden Would Ban and Criminalize the Modern Sporting Rifle

NEWTOWN, Conn. – NSSF®, the trade association for the firearm industry, is focusing on former Vice President Joe Biden’s radical antigun campaign promise to ban, register and confiscate the most popular selling centerfire rifles – the modern sporting rifle – sold in America today. Biden borrowed a page from the failed campaign of Robert Francis “Beto” O’Rourke to craft an agenda that would hobble Constitutionally-protected rights for law-abiding Americans.

“Joe Biden’s gun grab isn’t original, but is it is shockingly honest that they admit the end game. His campaign promise to confiscate guns rips the mask off the lie told by gun control for decades,” said Lawrence G. Keane, NSSF Senior Vice President and General Counsel. “Yes, they are coming for your guns. The Biden-Harris campaign literally spelled out how they would do this and would violate their oath to uphold and defend the Constitution, but instead destroy it.”

The Biden-Harris gun control agenda proposes to ban the sale and manufacture of modern sporting rifles, or what the campaign terms “assault rifles” or “weapons of war.” In fact, these firearms are just semiautomatic firearms that uses 100-year-old technology and have been sold commercially since the early 1960s. Semiautomatic firearms expend one round for each squeeze of the trigger, unlike the military’s automatic firearms that continue to fire automatically while the trigger is depressed. The Biden campaign is purposefully conflating the similar appearances of AR-15s and the military’s M-16 and M-4 rifles to confuse the American public.

Biden proposes that all 18 million-plus modern sporting rifles in circulation would be registered in the same onerous manner as automatic firearms and regulated under the 1934 Gun Control Act. That would require current owners to register these rifles with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), pay a $200 tax, submit fingerprints, photos, and complete duplicitous background checks for firearms they already passed a background check to purchase. They would also be subjected to random and unannounced ATF inspection of their firearm and would be registered in a federal watchlist of firearm owners. Further, permits regulated under the 1934 NFA are already backlogged by more than nine months.

The Biden campaign has a plan for those who would choose not to comply. Those individuals would be given two options: be forced to sell the property to the U.S. government using their own tax dollars to do so or face forcible confiscation by law enforcement authorities. Conservative estimates would require $9-18 billion of taxpayer funds to subsidize this gun confiscation scheme.

The Biden-Harris gun control plan would also ban the manufacture and sale of so-called “high capacity” magazines. His campaign website grossly compares hunting to the horrific murder of children, claiming the federal government protects ducks more than kids. This disgusting comparison is as wrong as it is appalling. Murder is illegal, plain and simple. The value of human life is undeniably greater than that of animals. That’s why the industry opposes these limits because in a moment of crisis when defending one’s own life, arbitrary magazine capacity limits put law-abiding Americans at a disadvantage to criminals who, by definition, disobey laws.

Modern sporting rifles are commonly and lawfully used for hunting, recreational and competitive target shooting and home defense. More than 5 million Americans purchased a firearm for the first time in 2020, based on a NSSF retailer survey. Fully 40 percent of these new gun owners are women. The largest increase of any demographic is among African-Americans, which skyrocketed 58 percent over 2019. To date, more than 13.8 million background checks have been completed for the sale of a firearm, surpassing 2019’s full-year total of nearly 13.2 million.

NSSF strongly opposes these unconstitutional proposals of the Biden-Harris campaign and encourages all Americans to vote on Election Day to protect their Second Amendment rights.

Sturm, Ruger & Company, Inc. (NYSE: RGR) announced today that its offer to purchase substantially all of the Marlin Firearms assets was accepted by Remington Outdoor Company, Inc. and approved by the United States Bankruptcy Court for the Northern District of Alabama. The Company will pay the $30 million purchase price from cash on hand at the time of closing, which is expected to occur in October.

Sierra Bullets to Acquire Assets of Barnes Bullets

– Combination Creates the Leading Specialty Bullet and Ammunition Platform With a Runway to $100 Million in Sales and 25-30% Adjusted EBITDA Margins –

SALT LAKE CITY — Clarus Corporation’s (NASDAQ: CLAR) (“Clarus” and/or the “Company”) subsidiary Sierra Bullets, L.L.C., the Bulletsmiths®, a dedicated manufacturer of one of the highest-quality, most accurate bullets in the world, was selected to acquire certain assets relating to the Barnes Bullets brand of specialty hunting bullets (“Barnes”) in a chapter 11 bankruptcy auction process conducted by Remington Outdoor Company, Inc. and certain of its subsidiaries.
Founded in 1932 and headquartered in Mona, Utah, Barnes is an industry-leader in manufacturing environmentally sound, lead-free bullets. Barnes is known for its superior quality and accuracy, offering a full line of premium component bullets and ammunition sold through nationally recognized retailers and e-commerce channels.

Sierra is expected to acquire Barnes for $30.5 million in cash, pursuant to an asset purchase agreement. For the trailing twelve months ended June 30, 2020, Barnes Bullets reported $21.8 million in sales. The acquisition is anticipated to be immediately accretive to Clarus’ earnings.

The acquisition of Barnes presents multiple strategic and financial benefits to the Company’s bullet and ammunition platform, most notably the addition of a comprehensive lead-free, all copper offering.

We now have a platform of scale that we expect to continue to deliver strong recurring revenue with high gross margins and free cash flow conversion. Clarus’ CFO, Aaron Kuehne, added: “The opportunistic and strategic acquisition of Barnes represents an accretive, tuck-in asset that brings our bullet and ammunition business additional capacity in a period of great demand and improves our overall scale within our Sierra segment. In addition, the acquisition presents significant financial and operational synergies that we expect to maximize with our strong balance sheet. As such, we expect our leading specialty bullet and ammunition platform has long-term runway to becoming a segment with $100 million in sales generating 25-30% adjusted EBITDA margins.”

The transaction is subject to the approval of the United States Bankruptcy Court for the Northern District of Alabama at a hearing currently scheduled for September 29, 2020, and other customary closing conditions. Once approved, the negotiated asset purchase agreement will be entered into and the transaction is expected to close in October.

More financial details on Barnes Bullets will be disclosed in Clarus’ upcoming third quarter earnings call, which is anticipated to be in early November.

U. S. Coast Guard Selects GLOCK Pistols

Default PERSPECTIVE ON EVENTS

Sunday morning. I have been thinking about much of what is going on…politically, socially, etc., as well as reading articles written by credible people in credible journals. Time for some perspectives approximately two months prior to the elections.

I believe Trump will wing again in November. As much division as there is, there are fewer people that want communism than they want freedom. Some notes about that. The word “American” used to mean something, but not any more. That communism is even a choise is indicative that Americans are just as stupid as the residents of any other country. But as I said…even some liberals will vote for Trump…or at the minimum refrain from voting much the same way that all those “freedom loving” evangelicals abstained from voting for Romney in 2012.

The election will of course be contested, this one perhaps more vociferously than the others. We saw this refusal to accept results for the first time in modern times when Bush defeated Gore. In this case expect the usual court drama with those pesky “hanging chads”. The biggest issue will be the extra legal activity against the members of the right…the conservatives and capitalists.

As I said would happen, the level of violence has been increasing rapidly. It is clear that this is happening largely in those contested areas run by liberals and populated heavily by liberals. Think Portland, Seattle, etc. As well, areas that are racially and socially mixed. The slogan in the past was that diversity was a strength. False…diversity leads to this sort of thing. You will not see hordes of BLeMmers or Antifas in locales that are strongly conservative and socially homogenous. And if you find yourself living or working in a contested area understand that you are on your own as is your family, your home, and your business because of the following points.

And we will note as well that the police will not intervene. Police administrators at WT please correct me if I am wrong as well, but what I see are police leaders with no testicles to enforce the laws they were hired to enforce and instead decide to placate the mob by allowing them to destroy the property of others. This in effect emboldens the mob to become more destructive and more violent. When that happens, expecting normal people to submit to the mob or simply evacuate as if fleeing a force of nature is unrealistic. Some, whose DNA has always been to obey and submit will go along, but others will not.

Understand that when the police fail to protect citizens and their property from the mob (Protect Life AND PROPERTY is the mission of the police), the citizenry will lose any respect or empathy for the police and instead they become a third force that has to be dealt with for their survival. That is what is happening in the contested areas when the police stand back and “contain” the riots rather than stop them. An agency that allows what is happening in Portland to go on should be ashamed to wear the uniform. My opinion, convince me I am wrong.

The foregoing is to illustrate some other points. In areas where the police do their job of protecting life and property, the citizenry expect a degree of protection from the mob. And they will get it because any attempted incursions will tend to be dealt with and stopped quickly. Those areas also happen to have a united culture and society. But should the police fail to do that, the citizenry will begin to take matters into their own hands. At first in a clumsy manner like we saw in the various recent flashpoints, but as the resistance grows, the sophistication will develop where the police become also irrelevant to the outcome of events. The police are able to investigate crimes and other events because there is an implied consent of at least one side of the situation. If that was lacking, and both sides comported themselves as guerrillas and insurgents, the police would arrive only to view the bodies and interview those survivors who lost and are then claiming victim status. That will be the American scene post election.
Think of the Irish “Troubles” as the most similar to what I expect we could face in the USA. Perhaps a bit like the Spanish Civil War. The difference between the two will be described below.

The main difference between the Irish War and the Spanish Civil War…or for that matter the Blakan War is the involvement of militaries on both sides. While the British did send military units to Ireland, the Irish did not have their own militaries involved to my knowledge and it was more of a COIN situation. There were assassinations, and gunbattles and bombings…all made more challenging due to the UK gun laws incidentally…but those paled in comparison to the actual military battles that took place in Spain and the Balkans. A civil war between insurgents and militias…with the police acting as antagonists to both, is one thing. A full pitched WW2-like battel in a city between two militaries is quite another. If that happens, the best thing to be is “not there”. As much rhetoric as I see from “former” military commanders I do not see that happening in the USA.

How Trump handles the events after his reelection will decide how he is judged by history and how the character of America will be for the rest of our lives.

Some suggestions…take them for what they are.

Locational – If you live in a socially mixed area that prides itself on diversity, move away. Unless you have a very compelling reason such as you are making more money than an Arab. I can almost guarantee that regardless of the election results, some places in the USA will go on as if nothing had changed. Others…not so much. Do that now because when your home has been set alight by the communists, you won’t get as much for it.

Educational – Teach your kids to be capitalists. The moment they utter a commie slogan, slap that shit right out of their mouths. If they are being indoctrinated by some janice Joplin hippy-chick teacher with hairy legs, take them to another school…a charter school or a private school where true American values will be taught and they will not grow up as commies.

Attitudinal – Stop being afraid of these commies and begin making them afraid of you. I am sick of the “run away” sentiment that I hear so often..even here. I am not discussing changing residences…you won’t save Portland…Portland and places like it are screwed forever. The time to “save them” was twenty years ago. What I am referring to is the sentiment to never take a stand. At some point you will have to so you may as well learn to do so.

Technical – Make your home a place where others are like you and not where they are different. Place outbound obnoxious lighting that can be directed toward approaching parties. Less welcoming is more better. Have rifles in every room…more or less. On the street always be armed. A pistol with at least two extra magazines is minimum. A small rifle and a fighting kit as discussed in the vehicles is important. Another factor of location is that you do not want to live in any location that prevents you from being armed.

Additional – Don’t be a Danny Dad-bod, or a Fat Freddy, or a Nicky Nice-Guy. The softer and nicer you look, the more you fit the stereotype of a submissive fearful white guy, the more likely the enemy will be to target you. The mob may be two or three, and not necessarily thirty. Make sure you are strong enough to throw a an through a plate glass window, off a balcony, or into traffic. And something I confess to not having done for years because I have not felt a need is the addition of a small can of OC spray. Keep it with you. If confronted by a group of belligerent commies with cameras and demands, hose them down head to toe. The time to stop being the fearful boy scout is at hand.

Since the start of the COVID-19 pandemic, gun sales and interest in firearms training have surged. Surveys, studies, and wild guesses have tried to capture the reason why people, particularly women, are purchasing firearms and gun safety training. This article reviews the trends, explores the impetus for the surge, and offers quotes from women who share their stories in their own words.

First, here are the facts: FBI data showed that 2.6 million guns were purchased in March alone (an 85% increase on the same period last year), with Illinois leading with close to 500,000 purchases, followed by Texas, Kentucky, Florida, and California. Ammo.com saw about a 1,000% increase in firearm sales in Colorado, Arizona, and Texas since late February.

Media outlets were among the first to guess the cause of America’s piqued interest in guns. An article in AS stated that it was the “imminent erosion of fire, police and health services [and] fears over looting, violence and burglaries.” Another article article in Salon stated, “the fear is about the economy collapsing, leading to a rise in crime and violence [and] decades of NRA propaganda have convinced people to associate guns with safety.”

To get better insight on the rise in gun sales, the National Shooting Sports Foundation (NSSF) surveyed firearm retailers about trends that they were seeing. The May 2020 survey results estimated that 40% of sales were to first-time gun owners, and that 40% of the first-time gun buyers were women.

The NSSF survey revealed that personal protection was the primary reason gun owners were buying firearms. Semiautomatic pistols were the most commonly acquired firearm by first-time buyers by a 2-to-1 margin over second-place shotguns. Modern sporting rifles, revolvers, and traditional rifles were also purchased by first-time gun buyers.

In July 2020 A Girl & A Gun conducted a survey of more than 6,000 members to specifically focus on women’s reasons and interests. Results showed that 43% of women joined AG & AG to practice self-defense skills, and 92% were in the process of obtaining or already have acquired their concealed or open carry permits. This complemented the NSSF survey data that 25% of first-time buyers had already taken some form of firearms safety course and 63% inquired about taking a firearms safety course in the near future.

In alignment with retailers’ sales, AG & AG also saw an influx of new memberships. In July 2020, memberships were up 150% over the previous year. A survey showed that 40% of respondents had been involved in firearms training for less than one year, and more than half involved for five years or less.

A follow-up survey of new first-time gun owners asked specifically what spurred them into seeking firearms training. Results showed:

8% Lack of law enforcement resources
7% Pandemic/uncertainty of access to essentials

3% Ammo shortage/concern of waiting
3% Stimulus check provided opportunity

The AG & AG survey results further proved that women are not only purchasing firearms, but they are investing in formal training as well. The survey verified that personal protection is the primary reason why women are seeking firearms training, and went further to enumerate the specific reasons, including civil unrest and the fear of bans after upcoming elections. Many women never considered formal firearms training as an option before learning about opportunities with A Girl & A Gun.

While the NSSF study stated that retailers’ new customers were spending $595 on an average sale, the AG & AG survey confirmed that some women used their stimulus check towards the purchase of a firearm. Other members shared that they did not receive a stimulus check in their household, but felt it was time to make the investment in their first firearm for themselves.

While all of women who participated in the New Shooter Survey were new to firearms training, the data showed that most were completely new to guns themselves. More than half (52%) did not grow up with firearms in the home. Some had firearms in the home but didn’t shoot (33%), and some had not shot a gun since they were children (15%).

Chandra in Ohio said, “Recently I decided that I needed to engage in some self care. Going to the range makes me feel empowered and I feel good about myself. My son likes to shoot so this also gives me a way to connect with him.”

Theresa in Nevada said, “I’ve never felt the need to own a gun or want a one. However, with the extreme levels of crime, every individual should learn to protect themselves. With our political leaders allowing the police to be torn apart, this made me feel the need to step up and take measures for my protection.”

Jessica in California said, “I was a victim of a home invasion when I was 16 years old, I had a gun pointed at my head. Ever since that happened, I promised myself that I would not be a victim again. I have two small children and my goal is to know how to use a pistol, rifle, and shotgun proficiently in case I experience the same scenario. I am also interested in the shooting competition world and I am ready to get out there and train. This club has been so welcoming to me and as a woman it is nice to see other women with the same mindset who share a passion for gun safety and shooting.”

Jan in Michigan said, “As a history teacher with 35 years of teaching experience I know that the first thing revolutionaries and tyrants do upon seizing power is to take away the public’s guns. As a child my family lived in inner city Detroit in the heart of the 1967 riots. We lived as hostages night after night under a 3:00 PM curfew everyday. Detroit has never recovered. More recently, the rioters came down my street after their burning and looting rampage downtown in my city of Kalamazoo, Michigan. I decided that I have to defend myself and not allow myself to be a sitting duck. “

Anonymous in Connecticut said, “I had been interested in joining A Girl & A Gun Club for a while and in the wake of the protests and defunding of police I thought this was extremely important. Being from the Northeast it is difficult to find others with the same ideals so I thought this would be the best place to start.”

Lori in Pennsylvania said, “I have taken classes before but to be honest, they were kind of a “dude” thing and I felt a bit uncomfortable. Finding A Girl & A Gun was fantastic for me! Knowing there are other women out there with an interest in firearms has given me a shot in the arm to get out and get trained properly. I am very excited about this opportunity.”

Conclusion

Survey results confirm that women are relying on AG & AG for training and confidence. The recent data is reminiscent of the 2014 NSSF Report on Women, which reported that “AG&AG women scored higher on confidence (3.93) than the general sample of women (3.82)” (page 59) and that AG & AG members “show their enthusiasm for guns and shooting activities through the number of guns they own, the amount spent on guns and accessories and the frequency of participation” (page 61).

AG & AG is now moving into its tenth year of educating women on the safe use and storage of firearms, and promoting women’s interest and participation in training and competitive and recreational shooting sports. The club’s mission is especially relevant today and the organization is stronger than ever.

Hornady Precision Hunter Steel Challenge

CCRKBA: Seattle Homicide Count More Proof Restrictive Gun Laws Failed

BELLEVUE, WA – A Wednesday report in the Seattle Times offers more proof that restrictions placed on law-abiding Washington State gun owners, plus a tax on gun and ammunition sales in Seattle, have dramatically failed to reduce violent crime as promised, the Citizens Committee for the Right to Keep and Bear Arms said.

In 2014, the Seattle-based Alliance for Gun Responsibility, a gun prohibition lobbying group largely funded by wealthy Seattle-area elitists pushed through Initiative 594, a so-called “universal background check” measure that was supposed to keep guns out of the wrong hands. In 2015, the Seattle City Council pushed through the gun tax that has never come close to its revenue forecast. In 2018, the gun ban lobby rammed through Initiative 1639, which prohibits young adults from purchasing any kind of semiautomatic rifle and requires an “enhanced” background check and 10-day waiting period, plus proof of training.

“All of these restrictive gun control measures have only penalized law-abiding citizens,” noted CCRKBA Chairman Alan Gottlieb. “All three have failed miserably, and the time has come for the gun ban lobby to admit it and allow each of these bogus crime fighting tools to be repealed. Indeed, gun prohibitionists should fold their tents and go home in shame, because their anti-violence ‘remedies’ have proven to be nothing more than snake oil.”

This week, Seattle reportedly matched its 2019 homicide total. With four months remaining in the year, the body count for the city, and likely the rest of the state, will only go up. Law-abiding gun owners are not the problem, and restrictive gun control laws are not the solution, CCRKBA said.

“The gun prohibition lobby should apologize to Washington gun owners,” Gottlieb said. “Not only has the Alliance for Gun Responsibility pushed to disarm honest citizens, it also sides with violent protesters who want to defund police, and whose occupation of a Seattle neighborhood earlier this summer resulted in four non-fatal shootings and two homicides where the victims were both Black teens.

“When all of these laws were proposed,” he recalled, “we predicted they wouldn’t work, an we’ve been proven right. Homicides have crept upwards over all of Washington state during the past few years. The billionaire-backed crusade against gun owners and their rights has been an unmitigated disaster. They’ve given people a false sense of security while trampling on their rights. How many more must die before the anti-gun right extremists admit they’ve been wrong?”

Federal Appeals Court Rules California’s Magazine Ban Unconstitutional

Duncan v. Becerra – Important Industry Advisory 

We have been asked by California retailers, distributors and ammunition magazine manufacturers across the industry whether Friday’s landmark decision by the U.S. Court of Appeals for the 9th Circuit in Duncan v. Becerra means they can now sell to California consumers, ship to California retailers or manufacture in the state for commercial sale in the state ammunition magazines capable of holding more than 10 rounds of ammunition (so-called “Large Capacity Magazines” or LCM).  The short answer is “NO.”

While the holding in Duncan is a tremendous victory for the Second Amendment, members of the industry should continue to refrain from selling or shipping into California LCMs until after the appeal proceeding is concluded or the stay is modified or lifted. This is because the U.S. District Court’s Order Staying In Part Judgment Pending Appeal, dated April 4, 2019, remains in effect “pending final resolution of the appeal from the Judgment.” The appellate proceedings have not concluded or been finally resolved, so the stay remains in place.

Stay tuned. NSSF will update you on developments, including when the appeal is over and you can sell standard-sized magazines in California.

The West Coast-based 9th Circuit Court of Appeals issued a ruling affirming an earlier decision that declared California’s 10-round magazine capacity limit unconstitutional. The decision said that “large-capacity magazines” are protected by the Second Amendment.

“California’s law imposes a substantial burden on this right to self-defense,” wrote Judge Kenneth Lee in the opinion. “The ban makes it criminal for Californians to own magazines that come standard in Glocks, Berettas, and other handguns that are staples of self-defense.”

“Its scope is so sweeping that half of all magazines in America are now unlawful to own in California,” Lee continued. “Even law-abiding citizens, regardless of their training and track record, must alter or turn over to the state any LCMs that they may have legally owned for years — or face up to a year in jail.”

“It makes unlawful magazines that are commonly used in handguns by law-abiding citizens for self-defense,” he said. “And it substantially burdens the core right of self-defense guaranteed to the people under the Second Amendment. It cannot stand.”

The Firearms Policy Coalition, which filed a brief in the case, “Strongly supports this lawsuit and filed an important legal and history brief in support of the plaintiffs at the 9th Circuit,” said the FPC in a statement.

“[Our] brief argued that so-called “large-capacity” magazines are inherent components of functional firearms, that such magazines are ‘in common use’ for lawful purposes, and are constitutionally protected.

“A weapon that is ‘unusual’ is the antithesis of a weapon that is ‘common,’” argued the FPC. “Thus, an arm ‘in common use’ cannot be ‘dangerous and unusual’ and is therefore protected.”

“While this was not our case, this is a victory for all gun owners and the majority opinion reflects our arguments in an amicus brief we submitted along with several other organizations,” said the Second Amendment Foundation’s Alan Gottlieb. “Most importantly, the panel majority used strict scrutiny to make its determination, and that is a huge milestone.”

“The 9th Circuit, led by a Trump-appointed judge, rules that ban on magazines with more than 10 rounds is unconstitutional,” said the NRA in a statement. “This case will have repercussions nationwide.”

The 2-1 ruling may be pushed into higher courts for more deliberation. And part of the court’s April 2019 stay remains in effect, which creates some confusion for would-be magazine buyers and existing owners of legally purchased magazines with larger than 10-round capacities.

While the court agrees that the magazine ban is unconstitutional, there are still older laws on the books that will need to be addressed concerning the manufacture, transfer or importation of these magazines in California once the final appeal of the original judgment is heard.

SAF, Defense Distributed Win Court Victory in 3D Gun Case

 

BELLEVUE, WA – The Fifth U.S. Circuit Court of Appeals has unanimously ruled that New Jersey Attorney General Gurbir Grewal is “subject to the jurisdiction of Texas courts” in a First Amendment case brought by Defense Distributed, a Texas-based firm, and the Second Amendment Foundation.

The case revolves around plaintiffs’ distribution of materials related to the 3D printing of firearms. Defense Distributed and SAF contend Grewal’s efforts to prevent publication of the information online violates their First Amendment rights. Grewal has been fighting to stay out of Texas federal court in this case. He is one of nine Attorneys General to file suit in the Western District of Washington to enjoin the State Department from authorizing the release of Defense Distributed’s files. The opinion may be read here.

However, just before Grewal and his colleagues sued in Washington state, SAF and Defense Distributed filed their own legal action in the Western District of Texas challenging what they say is “select enforcement actions taken by the state Attorneys General.” Grewal, according to court documents, moved to dismiss “for lack of personal jurisdiction.”

“No one is above the law or the constitution, not even attorney General Grewal,” said SAF founder and Executive Vice President Alan M. Gottlieb. “If you trample on the First Amendment rights of gun owners trying to exercise their Second Amendment rights, you will be headed for trouble.”

In its ruling, the 5th Circuit noted, “Grewal’s conduct beyond sending the cease-and-desist letter confirms his intent to crush Defense Distributed’s operations and not simply limit the dissemination of digital files in New Jersey. Grewal’s enforcement actions are selective. He has not targeted the many similarly-situated persons who publish Defense Distributed’s files on the internet…Instead, he has focused solely on Defense Distributed. Perhaps nowhere is this better illustrated than in Grewal’s efforts to enjoin the national distribution of Defense Distributed’s files by suing in Washington, far from his or the plaintiffs’ home state. Grewal has also threatened Defense Distributed’s founder, Cody Wilson, by name, promising to ‘come after’ ‘anyone who is contemplating making a printable gun’ and ‘the next ghost gun company.’ Together, these actions confirm Grewal’s intent to force Defense Distributed to close shop.”

CCRKBA Tells Seattleites “Arm Up, Demand Resumption of CPL Process”

BELLEVUE, WA – With the Seattle City Council preparing to slash police services, the Citizens Committee for the Right to Keep and Bear Arms is recommending that residents prepare for the worst, and as part of that effort they should buy a gun if that’s their choice, and demand that both the Seattle Police Department and King County Sheriff’s Office resume taking applications for concealed pistol licenses.

Both agencies stopped accepting new CPL applications more than three months ago, due to the COVID-19 outbreak, while processing renewals has continued. But this has left new gun owners unable to apply. Gun sales have spiked nationally due to the pandemic panic and civil unrest in downtown Seattle. City residents travel to gun shops in neighboring communities for their purchases to escape Seattle’s regressive gun and ammunition tax, said CCRKBA Chairman Alan Gottlieb.

“While the city council may believe crippling its police department is a politically smart move,” Gottlieb observed, “it’s going to directly impact public safety. Nobody should be surprised when more people buy guns and apply for carry licenses, only in Seattle and King County, applying for a CPL hasn’t been possible since March.

“Seattleites saw what happens when there is limited police response by watching what occurred in the so-called ‘CHOP’ zone in the city’s Capitol Hill neighborhood,” he noted. “Two teens were murdered, four other people were injured in shootings, and no amount of fluff reporting and official denial could conceal the anarchy.

“This effort to defund the police creates legitimate concerns among Seattle residents and people who work in the city about their safety,” Gottlieb said. “Preventing people from applying for a concealed pistol license is tantamount to denying them their right to bear arms under the state and federal constitutions.

“We know other agencies also suspended the CPL application process,” he noted, “and it is time for Seattle and King County to demonstrate some leadership by opening this process back up.

“We fully support anyone’s decision to buy a gun for personal protection,” Gottlieb said. “We encourage new gun owners to take a safety course, study the rules of gun safety, and practice safe gun handling. We also recommend they demand resumption of the carry license application process immediately. Rights delayed are rights denied.”

    BELLEVUE, WA – The recent gun-buying surge that began with the COVID-19 pandemic panic and continued through the civil unrest and riots following the death of George Floyd in Minneapolis police custody has created millions of new gun owners who will now eagerly protect their right to protect themselves and their loved ones, the Citizens Committee for the Right to Keep and Bear Arms predicts.

    “Look at all of the new people who suddenly decided to exercise their Second Amendment rights to keep and bear arms,” observed CCRKBA Chairman Alan Gottlieb. “We’ve witnessed something that is nothing short of a sea change, and in some cases might approach the level of epiphany, about gun ownership. We’ve heard anecdotal reports from all over the country about people flocking to gun shops who had never before owned a firearm. Now that they are gun owners, we expect them to be very protective of their rights.”

    March, April and May saw record numbers of background checks, according to FBI data and information from industry sources. June data should be out within days, and CCRKBA expects the trend to continue.

    “As we’ve said before,” Gottlieb recalled, “we welcome all of these new gun owners to the firearms community. We know many of them are minorities, especially Black and female citizens from literally all age groups, and they will find gun owners have a big tent with lots of room for newcomers. They can take advantage of training opportunities, meet new friends who share more interests than they might have suspected, and gain a new understanding of our efforts to protect the one fundamental right that actually protects all of the other rights.

    “We’re not surprised to hear about new first-time gun buyers who have discovered how much enjoyment they get out of shooting,” he added. “We’ve seen this with generations of new gun owners who may never have had any previous experience with firearms. Many of them discover a sense of empowerment that allows them, maybe for the first time, to understand they can take care of themselves, and that they are responsible for their own safety.

    “This new wave of gun owners could become a formidable force during this year’s election,” Gottlieb noted. “From now on, we expect millions of new gun owners to pay closer attention to candidates, and reject those who would trample on their Second Amendment rights. With legions of new gun owners ready to protect these newly-discovered rights, it could be a pretty scrappy election year with lots of surprises.”
