Breaking News on the NRA Law Suite

Wayne LaPierre has finally resigned
This is the editorial from today’s Shooting Wire.  I believe that it is spot on.  at the bottom of the editorial there is a link to subscribe to The Shooting Wire and I wholeheartedly recommend it.
After more than 30 years, numerous internal challenges, and a lawsuit set to begin this morning, Wayne LaPierre says he’s leaving his Executive Vice President/CEO position at the National Rifle Association….for health reasons. NRA photo.

Former NRA board members, fired former NRA executives and others who had run afoul of “WLP” over the years were celebrating the fact that after numerous failed attempts to oust him, he was ‘voluntarily” resigning.

Bewildered members, on the other hand, are wondering what that would mean for the organization. Some even claiming the New York Attorney General had succeeded in destroying the organization.

That is, I’m afraid, baloney.

The New York Attorney General has, despite her dislike of the NRA and the NRA’s assertions to the contrary, has done nothing she wasn’t obligated to do under New York statute.

As a New York-registered not-for-profit, charitable corporation, the NRA has legal obligations to use its funds for charitable purposes, not, as the AG wrote “to support the lavish lifestyles of senior management and organization insiders.”

Unlike LaPierre, Letitia James is doing her job. The fact it furthers her future aspirations is only icing on the proverbial cake.

For more than three years, the NRA’s longtime leader has focused on a single goal: protecting Wayne LaPierre.

In the face of accusations of insider dealing, corruption and general malfeasance, membership has nosedived. So, too, have donations. The organization has been forced to downsize, cutback programs, and virtually remove itself from the past two election cycles.

Meanwhile, more than one hundred million dollars of member funding has been spent on legal defenses that have, for the most part, failed. The ill-considered multi-million dollar Texas bankruptcy was dismissed as a “bad faith filing.” Successive motions to delay, dismiss and otherwise stop the trial set to begin this morning have failed. As the trial judge said last week, it’s time to let the outcome of the case rest on the facts.

Beginning today, the Brewer Firm has the opportunity to prove itself worthy of the expenditures. In open court, spin stops. That job likely grew more difficult late Friday afternoon when former senior NRA executive Josh Powell cut a deal with the AG’s office.

Powell, former Executive Director of Operations and Chief of Staff to LaPierre, was one of the five defendants in the lawsuit brought against the NRA and senior management. In his deal, Powell admitted to the Attorney General’s claims of wrongdoing. That deal buttresses the AG’s claims of corruption. Powell’s testimony will likely corroborate it. “Joshua Powell’s admission of wrongdoing and Wayne LaPierre’s resignation confirm what we have alleged for years,” Attorney General James said “the NRA and its senior leadership are financially corrupt.”

She also announced that the trial was “set to proceed on January 8, 2024, as planned.”

Shortly after news broke announcing LaPierre’s resignation, one of my friends sent me a text asking “did you ever think we’d live to see the day the NRA would fail…NOT from the anti-gunners but from THE NRA Themselves?”

That question jarred me into a realization that, for many, including however many millions of members remain, Wayne LaPierre is- or was the National Rifle Association.

He was not. He never was. That’s the myth sold to the membership. But that doesn’t mean “life without Wayne” won’t be difficult.

There are two possible courses at this point.

If the NRA wins, it can follow through on the long needed governance changes (and are now clearly stated on their website), or continue the conduct that got them into this situation.

Should the latter happen, the New York Attorney General -whomever it happens to be at the time – would have no recourse but to step back in.

Repeating that conduct would be so egregious an offense that a court would be hard-pressed not to grant the AG’s original request: to dismantle the organization and redistribute its assets to other organizations.

Should the NYAG win, there will be changes, but the organization will not be dismantled.

It might be effectively dismembered, but the NRA -at least the NRA described by its original charter- will remain.

Either way, it’s up to the members to figure out what to do with their organization.

Rather than a too-large board doing too-little oversight, the members must demand better.

Instead of militant talk and sheep-like compliance, the membership must make certain the organization reflects the wishes of the membership-not fealty to a figurehead.

However the case works out, there will be changes ahead.

Before the disastrous NRA Annual meeting in Indianapolis in 2019, I wrote that changes were necessary. Describing what I felt would be the the worst possible outcome, I also wrote than “The NRA must get its house in order. If it doesn’t the Attorney General for the State of New York will certainly do it for us- and no NRA member will like the results.”

There was apparently some clarity in my long-retired crystal ball at that point. Having watched what’s happened in the years since, there’s no chance of a prediction of the outcome of this trial. What has been said, done, and spent on this trial boggles the mind.

That having been said, I’m back in New York City and headed to the courthouse this morning.

I can’t imagine what I’ll see or hear- despite having been in many courthouses in the past half-century of reporting.

NRA Publications Announces 2024 Golden Bullseye Awards; New Freedom Award Added

The winners of NRA Publications’ 2024 Golden Bullseye Awards—now in their 22nd year—have been announced. The Golden Bullseye Awards recognize the firearm industry’s top products as voted on by NRA Publications’ staff editors. “Last year was one of massive new product introductions from the recreational shooting sports industry,” said NRA Publications’ Executive Director Doug Hamlin. “As a result, the NRA Publications editorial staff had some tough decisions to make to identify the best all new products.”

The awards are selected by the editorial staffs of four of NRA Publications’ properties through a rigorous evaluation process, and they are each reviewed by NRA Publications’ management. “Thank you to the dedicated NRA Publications editorial staffers who tested and evaluated hundreds of new products before making their 2024 Golden Bullseye selections,” said Hamlin.

The awards are presented by American Rifleman, “the World’s Oldest and Largest Firearm Authority,” NRA’s American Hunter magazine, the world’s largest circulation hunting magazine, NRA’s most contemporary Official Journal, Shooting Illustrated, as well as by NRA Publication’s fastest-growing web property, NRAWomen.com.

The Golden Bullseye Pioneer Award specifically honors outstanding personal achievement. The Pioneer Award spotlights the exemplary achievement and cumulative body of work of an individual, or members of a family, team or partnership, responsible for the development and introduction of shooting equipment that has made a profound, positive and enduring impact on the way Americans shoot and hunt.

2024 Golden Bullseye Pioneer Award Winner: Brandon Maddox, Founder/CEO Silencer Central

Brandon Maddox has revolutionized the suppressor industry in the United States in a mere 15 years. Well, I may have been remiss in updating here but, quite honestly, there hasn’t been much real news in the gun world sinceBiden was allowed by the establishment to steal the election.  If ever we have need the 2nd amendment, now is the time.  The Usuper in Chief is introducing anti gun legislation that he and his marxist buddies intend to use to gut the 2nd Amendment.  If we have been treated this shoddily by the ruling “elite” while we are heavily armed, what is it, we must ask, that they have planned for us after disarmament?  I for one, do not intend to be disarmed by anyone.  we have reached a cross roads in our nation’s history.  we have seen the unmasked face of corruption and totalitarianism, lurking just below the surface of the swamp.  We must stand ready to resist draconian policies that might be forced upon us.  We will continue to keep you entertained and informed here on High Caliber Radio.

OCC “Pauses” Fair Access Banking Rule

The Office of the Comptroller of the Currency (OCC) has “paused publication” of its rule to ensure large banks provide all customers fair access to their services. The OCC proposed the rule in November to “codify more than a decade of OCC guidance that stating that banks should risk assessments of individual customers, rather than making broad-based decisions affecting whole categories or classes of customers, when providing access to services, capital and credit.” The firearms industry was one of those “classes” being denied services. “The first salvo in the gun control fight has begun and the Biden Administration has fired the first shot by improperly interfering in the affairs of the OCC which is an independent agency,” says the National Shooting Sport Foundation’s Senior Vice President and Counsel Larry Keane. Global Ordnance Secures Contract with U.S. Army

SARASOTA, Fla. — Global Ordnance LLC, (GO) has been awarded an Indefinite-Delivery Indefinite-Quantity (IDIQ) contract number W52P1J-21-D-0001, on the U.S. Army’s Bulk Explosives Program for the supply of new production Type 1 Trinitrotoluene (TNT) to the U.S. Army. The Bulk Explosives Program IDIQ contract is for five years and has a ceiling value of $188,170,265.00, considering all IDIQ awards. As part of the initial award, Global Ordnance will deliver 1,000,000 pounds of TNT in 2021 to the U.S Army. Subsequent awards will be competed with two other companies.

Given the way the rest of 2020 has played out, I don’t know why I thought I’d only have to worry about putting together a personal message to put some final punctuation at the end of another year. I can describe 2020 in a lot of ways, but “another year” doesn’t do this year credit.

It seems 2020’s not done with us, at least not when it comes to news. And if the news today is any indication of what’s ahead, 2021 won’t be any picnic.

Today, the ATF is releasing for public comment, a “clarification” document regarding stabilizing braces- those devices that resemble gun stocks, but aren’t. They’re assistive devices that allow a person with physical issues to shoot a pistol style modern sporting rifle using only one hand.

The ATF calls the document “Objective Factors for Classifying Weapons with Stabilizing Braces”, but after looking it over it might best be described as “A Rubber Ruler That Will Allow Us to Kick Off An Unauthorized Massive Gun Registration and Eventual Confiscation Move.”

You should be able to see the rule- which was unpublished as we began our holiday hiatus- here. As you read it you’ll quickly realize the ATF’s not looking to clarify anything, other than their obvious intent to confuse what constitutes a legal brace to the point shooters will simply decide it’s not worth the risk of a felony charge and simply walk away.

For many of us, this is a new deal. For Alex Bosco, co-founder of SB Tactical, it’s just the latest in his ongoing battle to get clarity from the ATF. Bosco, a former Marine, came up with the idea for a stabilizing brace while at the range with a disabled friend. He came up with the idea for a device that would make it possible to shoot the AR/MSR-style pistol with one hand.

In 2012, Bosco received ATF approval for his brace, with the ATF saying the “submitted brace, when attached to a firearm, does not convert that weapon to be fired from the shoulder and would not alter the classification of a pistol or other firearm..such a firearm would not be subject to NFA controls.”

In 2014, the ATF re-affirmed that classification when it wrote that someone incorrectly using the brace as a stock wouldn’t change the device status, writing they “do not classify weapons based on how an individual uses a weapon.” In other words, incorrect usage wouldn’t make the gun in question an NFA item because it was incorrectly used.

In other words, Bosco’s been around the block – repeatedly -with the ATF on the whole brace thing. But talking with him yesterday, he was quick to classify this latest “clarification” as something much more concerning. To him, this document, the timing of its release, and the very narrow timetable for contents, and its attempt to “bribe” unsuspecting gun owners into accepting it via a potential “retroactive exemption” from NFA taxes, constitute “one of the largest gun registration and eventual confiscation attempts in history.”

“We’re honest folks,” he told me, “if you tell gun owners what’s legal, we’ll comply. But in order to comply we need clearly delineated rules. We’ve proven ourselves as capable of self-regulation.”

“But this,” he says, “is the most underhanded thing I’ve ever seen.”

The “this” he refers to isn’t just the document – it is confusing – but the entire circumstance around the release, from the timing of the document being published (December 18) and its very limited timeframe for public comment (the window for public comment closes on January 1, 2021).

“Any government agency,” Bosco told me, “needs to be clear with their guidelines. Parameters need to be defined, in terms that everyone can understand. What the ATF’s doing here isn’t clear, it’s deliberately causing law-abiding people to risk being charged with a felony.”

“This guidance,” he says, “is worse than meaningless. You’re left guessing on everything.”

He’s right. The document, although carrying no force of law at this point, says items to be used in their classification of a legal, versus NFA-regulated item include: type, caliber, weight, length, how it’s marketed, length of pull, sights and scopes attached to it, peripheral accessories mounted to it, the rear surface area of the brace, and, disturbingly, more.

Even more disturbingly, there are no definitive values for any of the items.

Long story short, this ATF move isn’t one that any gun owner can allow to go unchallenged.

It’s clearly been orchestrated to move into-and out of- the comment period with as little time- and notification- as possible. And dropping a potential bombshell like this during the Christmas/Hanukkah holidays -when companies and their employees are taking much needed breaks – is well-beyond the idea of coincidence.

Without all of us making our opposition known, there are approximately four-million brace owners in the country that could suddenly find themselves looking at felony charges.

In today’s news section you can see SB’s release about the whole deal. It contains information on how you can make your feelings known to everyone from the President and Congress to the ATF.

And with that, we’re closing the news book on 2020.

What I’ve written here doesn’t in the slightest resemble what I’d planned to write. But that seems most appropriate considering the kind of year we’ve come through.

#38 – A Model 15 in progress.  Barrel has been cut, and butt cut to round.  It will have a C&S fixed rear sight to replace the factory adjustable, and an XS sight on the front.

This week on High Caliber Radio we discussed deer rifles with low recoil.  We also discuss handloading and bullet casting.

 

There has been a tremendous amount of voter fraud in this week’s presidential election.  Check social media for videos showing all kinds of nefarious behavior.  I pray that this situation will be peacefully rectified and all the legal ballots counted.  Beware though, if one party takes over with coruption and fraud and we lose our ability to be represented at the ballot box, we will have but 2 choices:  accept the tyranny and watch our freedom go down the memory hole or use our second amendment rights as our founding fathers intended, to defeat tyranny and restore freedom, law and order.

Rather than discuss this week’s gun related news and This weekend’s episode of High Caliber Radio, I would prefer to use this time to emplore you all to go out and vote for Donald Trump.  I don;t care what your personal feelings for the man are.  We have a clear cut choice to vote for freedom and liberty or vote for the tyranny of marxism.  Biden is a puppet that will soon be swept aside to make room ffor the true believers, who, backed by Red China and George Soro’s  will destroy the greatest country on earth.  If you vote for Biden or you sit on your lazy ass and don’t vote, then you are selling your children and grandchildren down the river to tyranny the likes of which this continent has never seen.  My father and grandfather oten said that they fought fascism and communism overseas because they didn’t want to have to fight it here.  The fight is upon us, let’s do it at the ballot box so we don’t have to do it with the cartridge box.

This week on High Caliber Radio we will look at the aged ivory polymer grips offered by Boone’s Trading Company.  We will also talk about the Kalashnikov weapon systems.  we will further examine Joe Biden’s anti gun plans and look at his plan to get rid of modern sporting rifles.  The below article came out in the shooting wire and I think we need to reprint it here as there are some major announcements.

 

 

Yesterday, shortly after Safari Club International officially announced the cancellation of their 2021 Convention in Las Vegas, the NRA announced cancellation of the 2021 edition of their Great American Outdoor Show in Harrisburg, Pennsylvania. With Pennsylvania’s regulations showing no sign of change, the NRA realized the chances of a successful retail show -even one as successful as the Great American Outdoor Show- weren’t good.

The Archery Trade Association pulled the plug on the “analog” portion of their 2021 event last week. Outdoor Retailer had already moved its winter show to an all-virtual format.

Wednesday, the PGA of America added their PGA Merchandise Show in Orlando, the largest event in the golf industry, to a growing list of cancellations. It already included the Consumer Electronic Show another staple in the trade show industry.

There are few major shows still showing on the 2021 schedule. SHOT Show is one of them.

And the question nearly everyone is asking is simple: Yes or no?

The answer – right now– is “yes”.

But not even the NSSF is saying it’s the final answer.

The restrictions in Nevada right now would make SHOT impossible. The current 250/1,000 maximum occupancy regulations wouldn’t adequately staff the booths in a single exhibit hall, much less the three major halls and assorted ballrooms of SHOT Show.

But there’s still a chance that Nevada Governor Sisolak will relax the restrictions. And Las Vegas hospitality and trade events officials have done their best to convince him it is possible to have a trade show under the same regulations applied to casinos, restaurants and bars in Las Vegas.

They put together a mock trade show at the Sands Expo and Wynn to demonstrate to Sisolak and state and local health officials how events can be held safely under those guidelines. They’d hoped the demonstration would lead Sisolak to apply that 50% capacity regulation to trade/consumer shows.

It didn’t. But that doesn’t mean the situation won’t change.

And it wouldn’t take a 50% occupancy rule to permit SHOT to happen. If SHOT was allowed to operate at only 37.5% of capacity, it could still accommodate 50,000 people. SHOT, despite what your jostled body might tell you at the end of a long day, could operate fine under that restriction.

That having been said, NSSF and SHOT officials recognize that the executive orders have to increase dramatically in order to move forward with SHOT.

Which begs the question: is there a drop-dead date on a final decision about SHOT?

Governor Sisolak’s office says there will be an update for indoor parameters in November. The NSSF says “at that time we’ll evaluate whether those parameters will allow us to move forward with SHOT Show.” I’m told that in political-speak that means “after the election.”

Meanwhile, NSSF recognizes that potential exhibitors are incurring real costs- booth “build” and potentially shipping to/from Las Vegas.

But their goal is to serve “the overall industry” and that, they say, “requires waiting a bit longer.”

While we’re all waiting, preparations continue.

Yesterday, I sat in on an exhibitors webinar with Jeff Pressman, ConvExx president and CEO. In it, he laid out the 2021 SHOT Show floor plan, new entrances, one-way aisles, hand sanitizing stations and more.

SHOT Show 2021 will be decidedly different. That difference will now be far more profound than the significant change introduced by the addition of exhibit space at Caesars.

This year, as explained by Pressman, once you enter the SHOT area, you’re entering the same kind of “bubble” that has exists around professional sporting venues.You’ll be screened going in, watched to assure compliance with mask and distancing regulations, and then directed out so as to minimize as much contact as possible.

There are many challenges that most of us don’t consider. One is the uncomfortable feeling of participating in a salmon run when entering/exiting the SHOW.

This SHOT Show will feature staggered opening/closing hours across the various exhibit halls to minimize contact and the “salmon run” when all venues close simultaneously.

There will also be a far more hand sanitizing stations than ever before. In fact, Pressman said, there will be stations “approximately ever 50 feet” through the entire exhibition area.

The potential for the all-too-familiar SHOT Show gridlock, that point where people seem to congregate and stall throughout the show will also be minimized.

During his presentation, Pressman reminded exhibitors the new one-way aisles may mean reexamining or adjusting their booth setup so as to compensate for directed traffic flows.

Before yesterday’s webinar got rolling, the NSSF’s Chris Dolnack, addressed the SCI and NRA/Great American Outdoor Show cancellations made yesterday.

“We’re aware of the cancellations,” he said, “but we’re going to ask your forbearance because the governor’s office in Nevada indicates there won’t be any additional guidance or changes in the regulations until November.”

Apparently, everyone will be waiting – and wondering – about SHOT – at least a few more weeks. But anyone considering attending should realize that the occupancy regulations apply to hotels and restaurants. Places that are normally crowded may be less busy, but their capacities will be limited as well. If you have reservations, you’d be playing the long game by hanging onto them a bit longer.
